Terms of Service

Last updated: 1 March 2025 · Effective: 1 April 2025

1. Acceptance of Terms

By accessing or using MedKura Health Private Limited's platform ("MedKura", "we", "the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Nature of the Service — Important Disclaimer

MedKura is a second-opinion and care coordination platform — not a primary diagnostic service. All AI outputs (report analysis, risk scores, doctor matching) are advisory in nature and must be validated by a registered medical practitioner. MedKura does not provide emergency medical services. In a medical emergency, call 112 immediately.

3. Eligibility

  • You must be 18 years or older, or have parental/guardian consent.
  • Doctors must hold a valid NMC registration number.
  • Lab partners must hold valid NABL accreditation.
  • You must provide accurate information when registering.

4. User Obligations

  • You must not upload false, misleading, or another person's medical records without their consent.
  • You must not attempt to reverse-engineer, scrape, or abuse the platform.
  • You are responsible for maintaining the confidentiality of your OTP and session.
  • You must not use the platform for any unlawful purpose.

5. Payments & Refunds

Consultation fees are charged per session and processed by Razorpay. Fees are non-refundable once a consultation has commenced. If a doctor fails to attend a scheduled session, a full refund is issued within 5-7 business days. All prices are inclusive of applicable GST.

6. Intellectual Property

All content, AI models, software, and brand assets are the exclusive property of MedKura Health Private Limited. Your medical data remains yours. MedKura claims no ownership over documents you upload. We retain a limited licence to process your data to provide the Service.

7. Limitation of Liability

To the maximum extent permitted by law, MedKura shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited to the fees paid by you in the 3 months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence.

8. Governing Law

These Terms are governed by Indian law. Any dispute shall be subject to the exclusive jurisdiction of courts in Nellore, Andhra Pradesh, India. We encourage resolution of disputes through our grievance mechanism before initiating legal proceedings.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be notified via in-app notification and email (if provided) at least 14 days before taking effect.
